This data includes personal details of pro-democracy protesters, members of religious minorities, and the LGBTQ community, all of whom sought refuge in the U.S. to escape "grave danger" in Iran, as stated in the complaint.

The lawsuit claims that the U.S. has provided "detailed information on hundreds of Iranian detainees seeking asylum," including identifying information, familial relationships, political opinions, and reasons they feared the Iranian government. This data sharing allegedly began in March 2025 and has continued even during the current war between the U.S. and Iran. According to the complaint, this information could put asylum seekers at risk of persecution, torture, and death if they are deported back to Iran, and also endanger their families and acquaintances who remain in Iran.

Immigration and Customs Enforcement (ICE), part of the Department of Homeland Security (DHS), has denied the allegations, stating in a statement to NPR, "These allegations that ICE shared asylum application records with the Iranian government are false." ICE maintains that it is committed to ensuring that illegal aliens are informed of their right to communicate with their consular representatives and facilitates consular access to detained individuals in accordance with applicable laws, regulations, and agency policy.
Legal and Ethical Concerns
The lawsuit points out that federal regulations prohibit the sharing of information that would "reveal or infer that the individual to be removed had applied for asylum." The Trump administration's actions, as alleged in the lawsuit, not only violate these regulations but also put the lives and safety of asylum seekers and their families at grave risk.
