UN Inquiry Findings

The Independent International Commission of Inquiry on Ukraine determined that Russia's deportation and forcible transfer of Ukrainian children constitutes a crime against humanity and a war crime. The report identified 1,205 cases of children taken from Ukrainian territories by Moscow in 2022, with 80% of them not yet returned. Russian authorities at the highest level orchestrated the removal of thousands of children from the occupied areas, including Donetsk and Luhansk regions.

Putin's Direct Involvement

Vladimir Putin's direct involvement was visible from the start, according to the UN Commission. Moscow evacuated children just before its invasion, claiming they faced risks from Ukrainian attacks, then placed them in families or institutions and issued Russian citizenship. Putin previously called the accusations exaggerated and described the children as rescued from a war zone, insisting there was no issue with their return.

Challenges for Families

Parents and guardians often remain unaware of their children's whereabouts, leading to enforced disappearance as classified by the UN. One mother quoted in the report said, "I am still looking for my daughter, and I am terribly afraid of what she might think of me and how she survives in Russia, where many people hate Ukrainians." Children who return experience trauma and anxiety, including fears of abandonment after harsh treatment in Russian orphanages, such as being told their homeland no longer exists.

Efforts to Reunify Children

Ukraine has recovered 2,000 children so far, though many face obstacles traveling back due to the coercive environment in Russia. Maria Lvova-Belova, targeted by an International Criminal Court arrest warrant alongside Putin, described in an interview taking in a 15-year-old boy from Mariupol and re-educating him despite his reluctance. Moscow has failed to establish a system facilitating returns, instead focusing on long-term placement of children with families or institutions in Russia. US First Lady Melania Trump has reportedly been involved in facilitating reunification, stating she maintains an open channel of communication with Putin regarding child victims of the war.

International Precedent

Salem Michel Al-Salem, a former Syrian Air Force intelligence colonel, appeared in a London court charged with murder and torture as crimes against humanity related to events in Damascus in 2011 and 2012. His case marks the first UK prosecution of murder as a crime against humanity under the International Criminal Court Act 2001.

Human Toll and Next Actions

The deportations have caused deep distress for children, with reports of anxiety and fear stemming from severed family links and coercive conditions. Ukraine continues its efforts to locate and bring back the remaining children, such as the nearly 20,000 reported illegally sent to Russia and Belarus.
